The growing problem of real estate fraud continues to plague homeowners, lenders, title companies and others who transact in real estate. Deeds, mortgages and other instruments are often placed on record without the knowledge or consent of a homeowner, leaving unwary buyers and unprotected owners with expensive and seemingly insoluble tangled title issues. This seminar will explore not only how to handle a “quiet title” case intended to clear the record of a fraudulent instrument, but will further address new and innovative laws and techniques designed to help prevent those documents from being recorded at all, including electronic notarization and electronic filing of documents. Real estate attorneys, litigators, estate planning attorneys and divorce attorneys will all find aspects of the seminar pertinent to their respective practice, as the presentations will involve evidentiary questions, recording issues, and techniques for identifying and avoiding problems involving property fraud. What to do when you discover your title has been encumbered or compromised by a fraudulent document? What can buyers, sellers, mortgage lenders, recorders’ offices and notaries public do, and what are they doing, to eliminate the problem of fraudulent transfers?

Legal Services/Public Interest Lawyers: PBI waives tuition fees for the first 12 hours of CLE taken in each calendar year for attorneys employed full-time by many nonprofit legal services and public interest organizations providing legal services to individuals at no or de minimus fees. These attorneys may enroll for additional CLE courses at 50 percent of the highest member fee.
