The permit application and various supporting documentation for the above-mentioned applicant were reviewed by staff of the Commission Investigation Division. The investigation performed as part of the application process revealed that: • The application conforms to the written application requirements for police permits outlined in Los Angeles Municipal Code section 103.02.1. • The Police Permit Review Panel may issue this permit pursuant to Los Angeles Municipal Code section 103.109, which regulates the Motion Picture Show permit. • No criminal history for the Applicant that should prohibit granting of the permit existed in the California Department of Justice records at the time of investigation. • No adverse Police Commission permit or disciplinary history was found. • The Department of Building and Safety has deemed that the business is a permitted use at the location. • Notice of Application was sent to the appropriate Council District Office and Neighborhood Council. No objections received • Notice of Application was sent to the appropriate geographic police division. No objections received • Public input: None

Daily hours of operation shall begin no earlier than 9:00 a.m. and continue until one hour after the start of the last movie showing of the day, but not later than 2:00 a.m.

8.

The authorization granted herein for the sale of a full line of alcoholic beverages for on-site consumption is for a period offive(5) years from the effective date of this grant. Thereafter, this authorization shall become null and void and a new authorization will be required to continue the sale of alcohol. The applicant is advised that he/she should allow appropriate time for a new entitlement application to be processed and the application should be approved prior to the expiration date of this grant In order to continue the sale of alcoholic beverages at the restaurant.

9.

Should there be a change in the ownership of the property or the business operator, the property owner and the business owner/operator shall provide the prospective new property owner and the business owner/operator with a copy of

the conditions of this action prior to the legal acquisition of the property and/or the business. Evidence that a copy of this determination including the conditions required herewith has been provided to the prospective owner/operator, shall be submitted to the Condition Compliance Unit (CCU) in a letter from the new operator indicating the date that the new operator/management began and attesting to the receipt of this approval and its conditions. The new operator shall submit this letter to the CCU within 30-days of the beginning day of his/her new operation of the establishment. 10. Prior to the effectuation of this grant, a building permit to incorporate the tenant improvements inside the theatre, including the kitchen facilities shall be obtained from the Department of Building and Safety and approved by all jurisdictional City and County agencies, including the Office of Historic Resources The Department of City Planning shall review and approve the construction set of plans to ensure compliance with these conditions. The applicant shall provide a copy of the final approved plans to the Condition Compliance Unit and to the OHR to be maintained in their respective Case Files. 11.

Prior to the effectuation of this grant, a covenant acknowledging and agreeing to comply with all the terms and conditions established herein shall be recorded in the County Recorder's Office. The agreement (standard master covenant and agreement form CP 6770) shall run with the land and shall be binding on -any subsequent owners, heirs or assigns. The agreement with the conditions attached must be submitted to the Development Services Center for approval before being recorded. After recordation, a certified copy bearing the Recorders number and date shall be provided to the Condition Compliance Unit for attachment to the subject case file.

12. Prior to the beginning of operations, the applicant shall notify the Condition Compliance Unit when operations are scheduled to begin via email or U.S. Mail and shall submit a copy of the Certificate of Occupancy for the Case File. The notification shall be submitted to planninq.ccu(alacitv.orq, with the subject: "ZA2015-702-CUB-CU/Operation Notification". The applicant shall also submit (attached or mailed) evidence of compliance with any conditions which require compliance prior to the beainnina of operations. 13.

Prior to the beginning of operations, a camera surveillance system shall be installed and maintained to monitor interior and exterior areas of the premises, including entrances and exits, high-risk areas and sidewalk areas. Recorded tapes/images shall be maintained for a minimum period of ninety (90) days. The tapes shall be furnished to the Los Angeles Police Department upon request. The applicant shall provide evidence of the surveillance system to the Condition Compliance Unit by submitting an invoice/receipt from the installer, photographs

of the cameras installed, the central monitoring screen and a schematic plan cross-referencing the camera locations. The plan will be maintained in the CCU and be made be available to the Police Department and the Department of Building and Safety for the purpose of verification or inspections. 14.

Prior to the beginning of operations, the manager of the facility shall be made aware of the conditions and shall inform his/her employees of the same. A statement with the signature, printed name, position and date signed by the manager and his/her employees shall be provided to the Condition Compliance Unit. The statement shall state, We, the undersigned, have read and understood the conditions of approval to allow the sale and dispensing of a full fine of alcoholic beverages for on-site consumption, in conjunction the restaurant, known as and agree to abide and comply with said conditions. A copy of the conditions of this letter of determination shall be retained on the premises at all times and produced upon request by the Police Department, the Department of Building and Safety or the State Department of Alcoholic Beverage Control.

15.

Prior to the beginning of operations, 24-hour "hot line" shall be provided for complaints or concerns from the community regarding the operation. The 24hour phone number shall be posted at the following locations: a. Entrance to the theatre, visible to pedestrians b. Customer service area, The applicant shall maintain a log of all calls, detailing: date complaint received, nature of complaint, and the manner in which the complaint was resolved. This log shall be made available to law enforcement personnel upon request and presented as part of the application if and when a new application to continue the operation is submitted to the Department. Complaints shall be responded to within twenty four hours. The applicant shall provide photographs of the sign postings and a copy of the log to the Condition Compliance Unit for inclusion in the Case File.

16.

Prior to the beginning of operations, Electronic age verification device(s), which can be used to determine the age of any individual attempting to purchase alcoholic beverages, shall be maintained on the premises at each point of sale location. This device(s) shall be maintained in operational condition and all employees shall be. Instructed in their use prior to the sale of any alcoholic beverage.

17.

Within the first six months of the beginning of operations at this establishment, all employees involved with the sale of beer and wine shall enroll

in the Los Angeles Police Department "Standardized Training for Alcohol Retailers"(STAR). Upon completion of such training, the applicant shall request the Police Department to issue a letter identifying which employees completed the training. The applicant shall transmit a copy of the letter referencing Case No. ZA 2015-0412(CUB), from the Police Department to the Condition Compliance Unit as evidence of compliance. In the event there is a change in the licensee, within one year of such change, this training program shall be required for all new staff. 18.

Any music, sound or noise emitted that is under control of the applicant shall not constitute a violation of Sections 112.06 or 116.01 of the LAMC. There shall be no live entertainment in conjunction with the outdoor patio of any type.

19.

Dancing/nightclub is not permitted on the premises at any time. The use of the establishment shall remain as a movie theatre.

20.

There shall be no Adult Entertainment of any type pursuant to LAMC Section 12.70.

21.

Any public pay telephone on the property shall be located inside the theatre, not on the exterior.

22.

Loitering is prohibited on or around these premises or the area under the control of the applicant. "No Loitering or Public Drinking" signs shall be posted in and outside of the subject facility. Signs shall be in English and in the predominant language of the facility's clientele.

23.

The applicant shall be responsible for maintaining the area adjacent to the premises, including any parking area dedicated to the premises free of litter.

24.

The facility shall not be leased or contracted out to third party promoters for nightclub, concerts or similar activities. Private events, in which the general public is excluded from the theater (i.e. invite-only movie premiers), are permitted provided all required permits and approvals are obtained from the jurisdictional City, County and/or State agency.

25.

The applicant shall file a Plan Approval application within 12 months from the operational date of this determination. The operational date of this determination shall be identified and confirmed by the Planning Department's Condition Compliance Unit. The Plan Approval application shall be subject to filing fees established by the Los Angeles Municipal Code Section 19.01-E. A public hearing shall be conducted subject to notification requirements established by the Los Angeles Municipal Code Section 12.24-D. The purpose of the Plan Approval is to review the effectiveness of, and compliance with the express terms of the Conditions of this grant. Upon review of the effectiveness of and compliance with the conditions, the Zoning Administrator may modify such

conditions, delete, or add new ones as appropriate and require a subsequent plan approval, as necessary, and reserves the right to conduct this public hearing for nuisance abatement/revocation purposes. 26.

Prior to the issuance of any permit by the Department of Building and Safety, or prior to any of the following types of activities being undertaken, clearance from the Office of Historic Resources for the proposed work shall be obtained Cultural Resources(Designated Historic-Cultural Resource) a. The property shall be used for its historic purpose or be placed in a new use that requires minimal change to the defining characteristics of the building and its site and environment. b. The historic character of a property shall be retained and preserved. The removal of historic material or alteration of features and spaces shall be avoided. c. Each property shall be recognized as a physical record of its time, place and use. Changes that create a false sense of historical development, such as adding conjectural features or elements from other buildings, shall not be undertaken. d. Most properties change over time; those changes that have acquired significance in their own right shall be retained and preserved. e. Distinctive features, finishes and construction techniques or examples of skilled craftsmanship which characterize an historic property shall be preserved. f. Deteriorated historic features shall be repaired rather than replaced. Where the severity, if deteriorated, requires replacement of a distinctive historic feature, the new feature shall match the old In design, color, texture, and other visual qualities, and where possible, materials. Replacement of missing features shall be substantiated by documentary, physical, or pictorial evidence. g. Chemical or physical treatments, such as sandblasting, that cause damage to historic materials shall not be used. h. The surface cleaning of structures, if appropriate, shall be undertaken using the gentlest means possible. i. Significant archaeological resources affected by a project shall be protected and preserved. If such resources must be disturbed, mitigation measures shall be undertaken.

j. New additions, exterior alterations, or related new construction shall not destroy historic materials that characterize the property. The new work shall be differentiated from the old and shall be compatible with the massing, size, scale, and architectural features to protect the historic integrity of the property and its environment. k. New additions and adjacent or related new construction shall be undertaken in such a manner that if removed in the future, the essential form and integrity of the historic property and its environment would be unimpaired OBSERVANCE OF CONDITIONS -TIME LIMIT- LAPSE OF PRIVILEGES All terms and conditions of the approval shall be fulfilled before the use may be established. The instant authorization is further conditional upon the privileges being utilized within three years after the effective date of approval and, if such privileges are not utilized or substantial physical construction work is not begun within said time and carried on diligently to completion, the authorization shall terminate and become void. TRANSFERABILITY This authorization runs with the land. In the event the property is to be sold, leased, rented or occupied by any person or corporation other than yourself, it is incumbent upon you to advise them regarding the conditions of this grant. VIOLATIONS OF THESE CONDITIONS, A MISDEMEANOR Section 12.29 of the Los Angeles Municipal Code provides: "A variance, conditional use, adjustment, public benefit or other quasi-judicial approval, or any conditional approval granted by the Director, pursuant to the authority of this chapter shall become effective upon utilization of any portion of the privilege, and the owner and applicant shall immediately comply with its Conditions. The violation of any valid Condition imposed by the Director, Zoning Administrator, Area Planning Commission, City Planning Commission or City Council in connection with the granting of any action taken pursuant to the authority of this chapter, shall constitute a violation of this chapter and shall be subject to the same penalties as any other violation of this Code." Every violation of this determination is punishable as a misdemeanor and shall be punishable by a fine of not more than $2,500 or by imprisonment in the county jail for a period of not more than six months, or by both such fine and imprisonment.

BACKGROUND The Chinese Theater was built in 1926 and since its construction it has remained as a premier location for hosting multiple awards ceremonies and is an iconic symbol of the entertainment industry in Southern California. The Chinese theater is zoned C4-2D-SN; R4-2D with a corresponding land use of Regional Commercial land use designation. The surrounding area has experienced cyclical economic declines and improvements with accompanying population increase throughout the last four decades. On August 14, 1998, the Zoning Administrator approved the development of a 1.2 million square foot commercial center adjacent to the Chinese Theater(Case No. ZA98-0449(CUB)(CUX)(CUZ)(ZV)). This commercial center is immediately to the east and connected to the Chinese Theater site. The commercial center also known as the Hollywood Highland Shopping Center included 75 retail stores, 10 restaurants, 5 standalone bars, a 14 screen multiplex and a 5-star hotel. A Conditional Use Permit was approved authorizing the on-site sale of a full line of alcoholic beverages for the restaurant and bars. In addition, there are over 3,000 spaces of subterranean parking spaces on the sites. Surrounding properties are within the C4-2D, C4-2D and [QjR4-1VL Zones and are characterized by level to gently sloping topography and improved streets. The surrounding properties are developed with 2- to 13-story apartments, commercial buildings, surface parking lots and parking structures. Adjoining properties to the north of the subject site are zoned C4-2D and.PIR4-IVL are developed with two- to five-story apartments and commercial buildings occupied by a gas station and smaller hotels. Properties to the south of Hollywood Boulevard are zoned C4-2D and are developed with 2- to 13-story commercial buildings occupied by the El Capitan Theater and a general office building. Adjoining properties to the east of Highland Avenue are zoned C4-2D and are developed with 1- to 13-story commercial buildings. Adjoining properties to the west of Orange Drive are zoned C4-2D and P1R4-1VL and are developed with 2- to 12-story apartments and commercial buildings occupied by small retail businesses associated with the tourist industry. Hollywood Boulevard, adjoining the property to the south, is a Major Highway dedicated 100 feet in width, and is improved .with curb, gutter and sidewalk On January 16, 2001, the Zoning Administrator approved Case No. 20004320(CUB)(CUX) for an expansion of the entitlements previously granted under Case No. ZA-98-0449-CUB-CUX. The 2001 Grant, authorized five additional establishments for on-site sale of a full line of alcoholic beverages, authorized dancing in 6 of the original 10 restaurants and dancing and live entertainment in one of the five new establishments. Conditions contained in the 1998 determination were modified, clarified and incorporated as conditions of approval under the January 16, 2001 determination.

Previous Zoning Cases on the Subiect Site No relevant zoning cases were found on the site. Except for alteration permits issued by the Department of Building and Safety, no relevant permits were found on the site. The earliest permit on the site is Permit No. 4951 — issued on March 12, 1941,for the alteration to a motion picture theater. Case No. ZA-2003-1072-(CUB)(PA1) — On February 19, 2013 the Zoning Administrator approved a Plan Approval application modifying Condition No. 9 extending the term of the grant, Condition No. 10 originally prohibiting live entertainment and Condition No. 12 originally prohibiting admission charge in association with the sale of a full line of alcoholic beverages for onsite consumption at a restaurant accommodating 272 patrons. Status: Pending Effectuation Site Address: 6922 Hollywood Boulevard (Hooters Restaurant) Case No. ZA-2000-4320-(CUMUX)(PA10) — October 14, 2011, the Zoning Administrator approved plans to modify conditions for the on-site sale of a full line of alcoholic beverages, live entertainment and dancing in connection with the (Hard Rock Cafe). Status: Valid Site Address:6801 Hollywood Ave., Unit 105 Case No. ZA-2000-4320-(CUB)(CUX)(PA9) - On December 8, 2010, the Zoning Administrator approved modification of conditions to allow the hours of operation from 6 a.m. to 2 .a.m. daily and to permit 48 patron seats at bar area in lieu of no more than 10% of the total restaurant square feet of floor area with a maximum of 20 seats at bar area, in conjunction with a proposed restaurant/bar with patron dancing and live entertainment(Rolling Stone Cafe and Bar). Status: Valid

Status: Utilized CASE NO. ZA-98-0449-(CUB)(CUX)(CUZ)(ZV)(PA15) On September 1, 2011, The Zoning Administrator approved plans to permit the expansion of an existing 6,585 square-foot restaurant into a 10,648 square-foot restaurant with the sale and dispensing of a full line of alcohol beverages and a seating capacity for 544 patrons in the C4-2DSN Zone. Status: Utilized CASE NO. ZA-98-0449-(CUB)(CUX)(CUZ)(ZV)(PA14) - On November 15, 2007, The Zoning Administrator approved plans to permit the dining, dispensing of a full line of alcohol, dancing and live entertainment in a two-level restaurant that has an outside patio. Status: Utilized Site Visit: The project planner conducted a site visit on January 27, 2015 at approximately 10:00 a.m. The sidewalk was congested with pedestrian activity and the Courtyard on the site also contained heavy pedestrian activity. Tourists and visitors took photographs of the handprints and footprints throughout the site. During the field visit it was also found the prints were distributed throughout the site, except at door openings and at the connection with the Hollywood Highland Commercial Center. Public Hearing: The hearing was held on April 2, 2015 and was attended by the following individuals: Alwyn Hight Kushner, President & COO, TCL, Chinese Theatre IMAX; Art Rodriguez, Art Rodriguez & Associates, the representative; Officer Jeffrey Pool, Los Angeles Police Department, and Gary Benjamin, representing the 13th Council District. The following exhibits were presented at the hearing: 11-slide Power presentation presented by staff and labeled Exhibit B. Zarcone, Commanding Officer for the Hollywood Area, LAPD; an email dated April 17, 2015,from Alwyn Hight Kushner, President & COO for the TCL Chinese Theatre 'max. Staff presented the case and stated that there are concerns allowing on-site consumption and seating within the outdoor courtyard area because of its historical nature and the amount of pedestrian traffic that visits this site. He showed the areas in the courtyard which do not have any hand prints/ foot prints. Ms. Hight Kushner, testified to the expense of the recent renovations of the theatre and emphasized that they have worked very closely with the Historical Preservation Unit in order to preserve the character of the theater. She stated that in order to remain competitive with other theatres in the area and outside the area which offer alcoholic beverages to its patrons, the instant request is necessary. She stated that she is working closely with LAPD to reduce noise from the theatre affecting the residential uses adjacent to the site and to reduce loitering. She requested that the courtyard outdoor dining operation be allowed because the tourists do no spend any money while visiting the courtyard and the outdoor consumption of alcoholic beverages would be a much needed source of income. She stated that they had obtained approval from their Neighborhood Council (See letter dated March 31, 2015). However, in an email received on April 17, 2015, Ms. Hight Kushner withdrew the request to allow alcoholic beverages service in the patio area until such time when they can work out the details with the LAPD and the OHR. Officer Poole and Gary Benjamin stated no opposition for the indoor service of alcoholic beverages, provided the approval is conditioned appropriately, but that there were still working out the details for the outdoor service area. A request was made to maintain the file open for two additional weeks in order to allow the applicant to discuss a potential scenario that addresses the issues with the outdoor dining area. BASIS FOR CONDITIONAL USE PERMITS A particular type of development is subject to the conditional use process because it has been determined that such use of property should not be permitted by right in a particular zone. All uses requiring a conditional use permit from the Zoning Administrator are located within Section 12.24W of the Los Angeles Municipal Code. In order for the sale of a full line of alcoholic beverages for on-site consumption to be authorized, certain designated findings have to be made. In these cases, there are additional findings in lieu of the standard findings for most other conditional use categories. FINDINGS Following (highlighted) is a delineation of the findings and the application of the relevant facts to same:

That the project will enhance the built environment in the surrounding neighborhood or will perform a function or provide a service that is essential or beneficial to the community, city, or region. The Chinese Theater is part of a long established entertainment corridor along Hollywood Boulevard. It has provided wide entertainment to movie-goers and tourists since 1926. The Chinese movie theater is a historical landmark (LA-55 and LA-194) and has been the venue for many award ceremonies since its construction. The Chinese Theater attracts many tourists as well as residents visiting the popular Hollywood area and continues to be a strong magnet for national and international tourism alike. In addition to providing entertainment and being a strong tourist attraction, the Chinese Theater is surrounded by commercial establishments, restaurants, other theaters, the Hollywood Walk of Fame, the Kodak Theater, hotels and restaurants. Many of the restaurants and clubs surrounding the subject site sell alcoholic beverages for which conditional use permits have been obtained. The proposed sale of a full line of alcoholic beverages inside the theater will be compatible with the current trend adopted by many other theaters in Southern California, including in three theaters of the 14 theaters approved at the Hollywood Highland Shopping Center. Further, this trend is being duplicated in other parts in other theaters. A similar entitlement was submitted to the Planning Department on May 14, 2014, requesting the sale of a full line of alcoholic beverages at the Cinerama Dome, another historical landmark of similar nature In the Hollywood area. No public hearing has been scheduled at the time this report was prepared. The proposed sale and consumption of alcoholic beverages inside the Chinese Theater will enhance the movie going experience while enjoying a truly significant historic landmark in Los Angeles.

2.

That the project's location, size, height, operations and other significant features will be compatible with and will not adversely affect or further degrade the adjacent properties, the surrounding neighborhood, or the public health, welfare, and safety. The theater has occupied the site since 1926, known formerly as the famous Mann Chinese Theatre and later Grauman's Chinese Theatre (Chinese Theater). The commercial space and physical components of the building including size, height, and operation blend with the entertainment-related nature of the surrounding area. The property is commercially zoned C4-2D-SN and designated Regional Center Commercial under the General Plan Land Use designation. The sale of alcoholic beverages inside the Grauman's Chinese Theatres will continue to coexist with other compatible surrounding uses in the vicinity - Hollywood Highland Shopping Center, El Capitan Theater, hotels, retail establishments and surrounding restaurants.

As conditioned, the sale and consumption of alcoholic beverages will be limited to the inside of the theater thereby allowing the courtyard to be accessible to tourists and visitors as it's currently being access without any interference. 3.

That the project substantially conforms with the purpose, intent and provisions of the General Plan, the applicable community plan, and any applicable specific plan. The Chinese Theatre conforms to the purpose, intent and provisions of the General Plan, or Regional Center Commercial land use designation. The subject theater was originally built in 1926 and it has operated as a theater. since. Surrounding sites are developed with regional commercial, other historic theaters and the recently built Kodak Theater complex. The Chinese Theater anchors one end of this entertainment center which is surrounded to the east by the Kodak Theater complex with retail commercial establishments and restaurants catering to tourists and visitors. As part of this entertainment complex the Loews Hollywood Hotel anchors the northern portion of the site(s). The Chinese Theatre is a major tourist and entertainment destination and allowing the sale of alcoholic beverages will enhance the entertainment experience for movie goers. The proposed sale of a full line of alcoholic beverages to the movie goers will not have any impact to the surrounding areas. Equally important as to the pedestrian flow, is the continued and uninterrupted access to the courtyard's handprints and footprints memorializing Hollywood's important figures. These prints on concrete panels are an acknowledgement to only a few of the very important personalities which shaped Hollywood as one of the centers of the entertainment industry in the world.

The proposed use will not adversely affect the welfare of the pertinent community. Allowing the sale of alcoholic beverages will not impose negative effects on the surrounding community. The theatre has operated in an existing tenant space for many decades, the surrounding community has developed around this historic structure and the impacts associated with the operation of the Chinese Theater have been long established. The sale of a full line of alcoholic beverages for indoor consumption at the Chinese Theatre will not affect the public welfare or safety, a full beverage service will enhance the movie going experience. Issues associated with parking, traffic, and noise will not be generated or increased by allowing the service and consumption of alcoholic beverages inside the theater. These issues have been addressed under separately and this permit will not diminish nor delete the conditions regulating the theater's operations.

The granting of the application will not result in an undue concentration of premises for the sale or dispensing for consideration of alcoholic beverages, including beer and wine, in the area of the City involved, giving consideration to applicable State laws and to the California Department of Alcoholic Beverage Control's guidelines for undue concentration; and also giving consideration to the number and proximity of these establishments within a 1,000-foot radius of the site, the crime rate in the area (especially those crimes involving public drunkenness, the illegal sale or use of narcotics, drugs or alcohol, disturbing the peace and disorderly conduct), and whether revocation or nuisance proceedings have been initiated for any use in the area. Although there are restaurants and other venues which sell alcoholic beverages in the immediate vicinity the sale of alcoholic beverages is incidental to ancillary uses, such as restaurants, hotel, bars, etc. The subject sale of alcoholic beverages inside the Chinese Theater will be in conformance with a trend throughout movie theaters in Southern California to sell alcoholic beverages inside the theaters. Approving this application will not result in an undue concentration of similar uses (sale of alcohol at inside theaters) with the type of alcoholic license requested (Type 47- On Sale General Eating Place) licenses but rather allow the Chinese Theatre to competitively operate in the commercial center and commercial corridor. Within 1,000 feet of the subject, the following types of alcoholic beverage licenses are active or pending: (4) (3) (20)

To mitigate any adverse impact, crime deterrent conditions have been incorporated in this permit to ensure public safety. Conditions recommended by the Los Angeles Police Department, those related with STAR training for employees an, age verification and security cameras have been imposed by the decision maker in conjunction with this approval. Further, this grant is authorized for a term of years after which time the applicant is required to file for a new entitlement to continue the alcoholic beverages inside the theater for on-site consumption. As conditioned, the Plan Approval requirement for this grant allows the City an opportunity to review the operation of the establishment anew. An appropriately and responsibly conducted operation that has not created problems for the

neighborhood will be considered favorably by the Zoning Administrator in any subsequent zoning entitlement requests for the establishment. Conversely, a record of poor compliance or documented nuisance complaints would allow the City the discretion to not grant or renew a conditional use, thereby avoiding the need to conduct prolonged nuisance abatement proceedings. Therefore, as conditioned, the project is not expected to contribute to the crime rate in the area or result in an undue concentration of establishments providing alcoholic beverages. In these active commercial areas where there is a demand for licenses beyond the allocated number and where an over-concentration of licenses is suggested, the ABC has recognized that high-activity retail and commercial centers located within major entertainment centers such as Hollywood are supported by a significant visitor/employee population in addition to the increasing resident population base in this revitalized area. The ABC has discretion to approve an application if there is evidence that normal operations will not be contrary to public welfare and will not interfere with the quiet enjoyment of property by residents. This is reflected in the licensing statistics noted above.

The proposed use will not detrimentally affect nearby residentially zoned communities in the area of the City involved, after giving consideration to the distance of the proposed use from residential buildings, churches, schools, hospitals, public playgrounds and other similar uses,and other establishments dispensing,for sale or other consideration, alcoholic beverages, including beer and wine. Hollywood has undergone a significant resurgence during the last decade. The Hollywood Highland Shopping Center assured that for a number of years, the Academy Awards to be held at the Kodak Theater. This transformation has made Hollywood relevant once more nationally and internationally. As conditioned, the

proposed sale of alcoholic beverages inside the Chinese Theater will not be detrimental to the surrounding residential land uses located to the north of the theater. Proper management and restrictions for the sale of alcoholic beverages will be observed and contained within the theater itself. The proposed sale of alcoholic beverages inside the theater will not detrimentally affect surrounding zones because it conforms to the designated commercial zone and similarly conditioned as the theaters permitted to sell alcoholic beverages at the Hollywood Highland Shopping Center. ADDITIONAL MANDATORY FINDINGS 7.

The National Flood Insurance Program rate maps, which are a part of the Flood Hazard Management Specific Plan adopted by the City Council by Ordinance No. 172,081, have been reviewed and it has been determined that this project is located in Zone C, areas of minimal flooding.

On March 4, 2015, the subject project was issued a Mitigated ENV-2015-413MND (Article V — City CEQA Guidelines) and determined that by imposing conditions the impacts could be reduced to a level of insignificance.

The police permit application process allows the City to obtain information concerning ownership of a business and to inspect the ongoing operation during normal business hours. A background check is also performed during the processing of the application. On October 15, 2014, a procedure was adopted to inform neighborhood councils of First Amendment* applications pending action by the Pol'ce Pe m't Review Panel.

These applications generally are processed within 30 days from the date of receipt of a complete application by the Board of Police Commissioners. Persons objecting to the granting of these permits should present reason(s)for the objection quickly. CAFE ENTERTAINMENT/SHOW (LAMC 103.102)* Live entertainment. Includes a disc jockey(DJ) to the extent the DJ performs for/entertains the public. Includes karaoke. CAFE ENTERTAINMENT/SHOW-ADULT (LAMC 103.102)* Is the Cafe Entertainment/Show permit at an establishment where the applicant has indicated that entertainment will include a person who performs specified sexual activites or displays specified anatomical parts in the business. See LAMC 103.01. Shall conform to additional requirements. PICTURE ARCADE (LAMC 103.101)* Coin-type or electrically controlled still or motion picture machines, image producing devices maintained to display images, or still or motion pictures to five or fewer persons per machine at any one time. MOTION PICTURE SHOW-ADULT(LAMC 103.109)* Is the Motion Picture Show permit at an establishment where the applicant has indicated that a substantial portion of the total presentation time is devoted to the showing of material which is characterized by an emphasis upon the depiction or description of specified sexual activities or specified anatomical parts. See LAMC 103.01. WHY AM I RECEIVING THIS NOTICE? Traditionally, notices of appliation for police permits were sent by hard copy.
